1. Scope and provider

These general terms and conditions govern sales by Pharma Biologica – Biologische Arzneimittel GmbH to consumers and business customers in the version valid at the time of ordering. Orders are placed exclusively by individual enquiry, for example by email, telephone, fax or through the website contact form. Different terms proposed by the customer are not accepted. By placing an order, the customer agrees to these terms.

2. Formation of the contract

The language of the contract is German. This English translation is provided for information and is not legally binding. Our offering is directed at customers in Germany and abroad. Customers must be at least 18 years old.
Product information is not a legally binding offer; it is an invitation to contact us individually. A contract is formed upon our order confirmation or delivery of the goods. Orders exceeding normal household quantities and purchases for commercial resale require our agreement.
Order details are stored and made available on request.

3. Prices and delivery charges

All prices include VAT. Delivery charges are calculated individually and communicated during the ordering process. In cases of obvious pricing errors, we reserve the right to contest the transaction under Section 119 of the German Civil Code (BGB). Prices valid at the time of ordering apply.

4. Delivery and cancellation

Goods are delivered to the address supplied by the customer. Delivery times are non-binding unless otherwise agreed. You will be informed if goods are unavailable. The customer bears costs resulting from unsuccessful delivery attempts. Dispatch takes place after receipt of payment or according to the agreed payment method. Each partial delivery forms a separate contract.

5. Customs

Deliveries outside the EU may incur customs duties and charges, which are payable by the customer. The customer is responsible for compliance with import requirements.

6. Payment

Accepted payment methods are invoice (Germany only) and advance payment. The provider may exclude payment methods. Cash and cheque payments are not available. In the event of late payment, we reserve the right to claim reminder costs and damages. SEPA mandates and payment deadlines must be observed.

7. Set-off and rights of retention

Set-off is permitted only against undisputed claims or claims established by a final court judgment. Rights of retention apply only to claims arising from the same contractual relationship.

8. Retention of title

The goods remain our property until payment has been received in full.

9. Transport damage

Please report obvious transport damage promptly. This does not affect your statutory rights.

10. Rights relating to defects

Consumers have a statutory warranty period of two years. The period may be shortened for used goods. Business customers receive repair or replacement. The limitation period for business customers is one year, except for injury to life, body or health and cases of intent or gross negligence.

11. Liability

We are liable for intent, gross negligence and injury to life, body or health. In cases of slight negligence, liability is limited to breaches of essential contractual duties and to foreseeable losses. The German Product Liability Act remains unaffected. These limitations also apply to persons performing obligations on our behalf.

12. Information on withdrawal for consumers

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you, or a third party designated by you who is not the carrier, take possession of the goods. If several goods ordered in one order are delivered separately, the period starts when the last item is received.

You may use the model withdrawal form below, but it is not mandatory.

To meet the deadline, it is sufficient to send your withdrawal notice before the withdrawal period expires.

Effects of withdrawal

If you withdraw, we will reimburse all payments received from you, including delivery charges, except additional charges arising from your choice of a delivery method other than our least expensive standard delivery. Reimbursement will be made without undue delay and no later than fourteen days after we receive your withdrawal notice. We will use the same payment method as for the original transaction unless expressly agreed otherwise; you will not incur any reimbursement fees.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of returning them, whichever is earlier.

You must return or hand over the goods to Pharma Biologica – Biologische Arzneimittel GmbH, Solinger Str. 22, 40764 Langenfeld, Germany, without undue delay and no later than fourteen days after informing us of withdrawal. The deadline is met if you dispatch the goods before the fourteen-day period expires.

You bear the direct cost of returning the goods.

You are liable only for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

13. Jurisdiction and applicable law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Where legally permissible, the place of jurisdiction is Langenfeld.
